What Is Workers' Compensation?
The Pennsylvania Workers' Compensation Act provides for your medical expenses and, in the event you are unable to work, wage-loss compensation benefits until you are able to go back to work. Benefits are paid by private insurance companies, by the State Workers' Insurance Fund (SWIF), or by employers themselves.
Are There Time Limits?
Unless an employer has knowledge of the injury, or the employee gives notice to the employer within 21 days of the injury, no compensation is due until notice is given. Notice must be given no later than 120 days after the injury for compensation to be allowed. If your request for benefits is denied by your employer or your employer's insurance carrier, you have three years from the date of the injury to file a Claim Petition.
Can I See My Own Doctor?
For the first 90 days after the injury, you must consult a "panel doctor," one included on a list of doctors selected by your employer and posted at your place of employment. After that time period, you can be treated by the doctor of your choice. There are exceptions to this general rule, so be sure to consult a lawyer if your employer has not accepted your injury or has not provided the list of panel doctors.
